2025 TERMS & CONDITIONS FOR DESIGN SERVICES
These Terms & Conditions govern all design-related services provided by Scarlet Reagan, LLC ("Designer"), including consultations, sourcing, styling, installations, and any related services for Clients who engage us without a formal contract. By paying an invoice or otherwise engaging Scarlet Reagan, LLC, the Client agrees to these terms.
1. SCOPE OF SERVICES
Design services may include concept creation, sourcing, purchasing, styling, and light space planning. These services are offered at the Designer's discretion and availability. Formal design plans, drawings, or contractor-ready documents are not included unless explicitly stated.
2. BILLING & TIME
Design time is billed at an hourly rate, rounded to the nearest 15 minutes. Billable activities include: client communication, shopping, sourcing, styling, vendor interaction, coordination, and travel. A minimum charge may apply for short projects. Rates are subject to change each calendar year.
Current Hourly Rate: $220/hour
3. PRODUCT SOURCING & PURCHASING
If the Client requests to purchase furnishings or accessories through Scarlet Reagan, LLC, pricing may include a markup to cover procurement, vendor relationships, handling, logistics, and credit card fees. Custom items or special orders are final sale. Designer may also use items from its retail store inventory or trusted vendors at retail or marked-up prices.
4. INSTALLATION SERVICES
Installation of furnishings, art, and accessories may be available as an add-on service. Any unapproved Install Accessories used during the install will be invoiced post-install. Returns are accepted only if requested in writing within 24 hours and the items are returned in perfect condition within 48 hours to the store. A 25% restocking fee applies. Time and mileage for Designer-facilitated returns will be billed.
5. PAYMENT TERMS
Invoices are due upon receipt. A $35/day late fee applies after 24 hours, and additional fees may apply for ongoing nonpayment. If any invoice is more than 14 days late, services may be paused.
Accepted payment forms include: check, Venmo, Zelle, ACH, or credit card (with fees).
6. CANCELLATION POLICY
Cancellations or reschedules for styling appointments or installations require 48 hours’ notice. For cancellations within that window, time incurred and a minimum cancellation fee of $150 may be charged.
7. INTELLECTUAL PROPERTY & USE OF DESIGNS
All designs, styling ideas, and sourcing recommendations remain the intellectual property of Scarlet Reagan, LLC. Clients may not copy, reverse-engineer, use AI, or image-search to independently source items without prior written consent. Doing so may result in a Design Release Fee of 20% of the items’ retail value.
8. PHOTOGRAPHY & MARKETING
Designer retains the right to photograph all styled or installed spaces and to use such images for promotional, portfolio, or social media purposes unless the Client requests otherwise in writing.
9. LIMITATIONS & DISCLAIMERS
Design suggestions are made in good faith based on aesthetic, budget, and availability at the time. The Designer is not liable for manufacturer defects, shipping delays, color variations, or third-party contractor performance.
10. GOVERNING LAW
These terms are governed by the laws of the State of Texas.
